Transparency Requirements for AI Data Usage

From July 20, companies utilising personal data for generative AI development or enhancement must issue AI-specific notifications to their users. These disclosures aim to increase transparency regarding the handling of various data types, including names, contact details, photographs, voice recordings, biometric information, and financial or transaction records. While companies must inform users, the guidelines do not prescribe a uniform format for these notifications, allowing flexibility in their presentation.
Limitations on Consumer Control

Despite the emphasis on transparency, the new guidelines do not make it compulsory for companies to offer consumers a pathway to opt out of their data being used for AI training. This means that while individuals will be informed about the use of their data, they may not always have the ability to prevent it. Nevertheless, entities such as banks, insurers, and social media platforms are prohibited from denying services to consumers who do not consent to their data being used for AI training purposes.
Exceptions for Anonymised Data

Organisations are exempt from issuing these specific notifications when they employ anonymised data. This exception applies to data that has been processed in such a way that it can no longer be linked back to any identifiable individual. The focus of the notification requirement is therefore on the use of personal data that retains its individual attribution.
