The National Human Rights Society of Malaysia (Hakam) believes that the establishment of the Independent Police Complaints and Misconduct Commission (IPCMC) will lead to a reduction or elimination of deaths in custody and instances of abuse by the police. This new commission is intended to replace the Enforcement Agency Integrity Commission (EAIC).
Powers of the Proposed IPCMC

Hakam has emphasised the critical need for the IPCMC to be an independent body with the authority to investigate complaints and misconduct within the police force. Crucially, it should also possess the power to impose penalties for such misconduct. This contrasts with the current structure of the EAIC, which Hakam states has been ineffective in ensuring police accountability.
Failures of the Current EAIC

The EAIC, as it is presently constituted, has been unable to bring about police accountability in Malaysia. While it can investigate and document complaints, and subsequently submit recommendations to the police, the EAIC lacks the power to compel the police to accept or implement these recommendations. Furthermore, the EAIC does not possess any enforcement powers, rendering it unable to function effectively under the current EAIC Act 2009, according to Hakam.
Basis for the IPCMC Bill

For the IPCMC to be effective, Hakam suggests that the Bill for its establishment should be based on the draft prepared by the Royal Commission to enhance the operation and management of the Royal Malaysian Police. This draft is considered to be aligned with international standards for police accountability. Hakam notes that similar oversight mechanisms in other jurisdictions have proven effective in achieving police accountability.
