Datuk Zarul Ahmad Mohd Zulkifli, director of Consortium Zenith Construction Sdn Bhd, stated that Lim Guan Eng informed him of the condition while driving him home in early March 2011. The specific requirement was that the project would be awarded via direct negotiations if a signing ceremony for an MoU between the state government and a company from China could be successfully arranged, and crucially, if this ceremony was witnessed by China's premier.
MoU Signing Ceremony Details

The witness further testified that Lim Guan Eng expressed pleasure when the MoU signing ceremony between the Penang state government and Beijing Urban Construction Group (BUCG) for the mega project took place. This significant ceremony, which concerned the roads and undersea tunnel project valued at RM6.34 billion, was indeed witnessed by the Prime Ministers of Malaysia and China. The MoU signing ceremony was held in Putrajaya on April 28, 2011, and was attended by then Chinese Premier Wen Jiabao and then Malaysian Prime Minister Datuk Seri Najib Razak.
Allegations of Bribery and Inducement

Lim Guan Eng is facing allegations of using his position as Penang Chief Minister to receive bribes totalling RM3.3 million. These alleged bribes were purportedly in exchange for assisting Zarul Ahmad's company in securing the RM6.34 billion highway and undersea tunnel project. Additionally, Lim is alleged to have solicited a 10 per cent bribe from Zarul Ahmad as an inducement to facilitate the company's appointment for the same project. These alleged acts occurred between January 2011 and August 2017 at the Penang Chief Minister's Office.
