High Court Dismissed Forfeiture Application

On July 24 last year, the High Court, presided over by Datuk Ahmad Shahrir Mohd Salleh, rejected the MACC's application to forfeit RM100,000 from Kasitah Gaddam. This decision was based on the prosecution's failure to meet the required burden of proof for forfeiture proceedings.
Insufficient Proof of Unlawful Origin

In his judgment, Datuk Ahmad Shahrir stated that the court found the prosecution had failed to demonstrate that the RM100,000 seized from Kasitah Gaddam's CIMB Bank account constituted proceeds derived from unlawful activities. This lack of substantive evidence was central to the court's rejection of the forfeiture.
MACC's Stay Application Rejected

Subsequently, the MACC sought a stay of execution on the High Court's decision. However, this application was also dismissed by Judicial Commissioner Datuk Ahmad Shahrir Mohd Salleh, meaning the MACC's attempt to halt the execution of the earlier ruling was unsuccessful.
