Justice M. Gunalan concluded that OC Phang, the former general manager of PKA, owed a duty of care to the authority. The court found that Phang's defence, which relied on acting under instruction, was not substantiated by any witness testimony.
Damages to be Assessed by Senior Assistant Registrar
