Conversely, Datuk Che Mohd Ruzima Ghazali found that the Court of Appeal had correctly concluded that the prosecution failed to establish all four charges against Syed Saddiq. Ruzima elaborated that the mere withdrawal of funds did not, in itself, constitute criminal breach of trust, and that the constitution of Bersatu primarily governed internal party matters.

Ruzima further explained that the prosecution had not established the principal offence of criminal breach of trust, which consequently meant they could not prove the abetment charge against Syed Saddiq.
