Application Letters Prepared for All Bidding Companies

Aliza Abd Malek testified that she personally drafted five separate application letters addressed to then-prime minister Tan Sri Muhyiddin Yassin for the IPD Klang Utara project. These letters were for Nepturis Sdn Bhd and four other companies: Permata Rebana Sdn Bhd, Fastcoll Corporation Sdn Bhd, JM Letrik Sdn Bhd, and MZ Hakujaya Sdn Bhd. All five companies were participating in a pre-qualification tender process under the Jana Wibawa initiative, which required at least five Bumiputera companies.
Instructions from Lian Tian Chuan

The preparation of these application letters for all five companies, including competitors, was carried out on the instructions of Lian Tian Chuan, who held a 30 per cent stake in Nepturis through a verbal agreement. Aliza confirmed that Lian Tian Chuan was in contact with the directors of the other four companies, whom she referred to as Lian's "business partners," and instructed her to write the application letters for them as well. While the draft letters were provided, Aliza stated that the other companies were free to amend the font and sentences, and Nepturis submitted its tender based on its own price offer without a pact with the other firms.
Involvement in Another Project Tender

This practice of assisting multiple companies with their project applications extended to another government project in 2021: the Central Spine Road: Sertik to East Coast Highway interchange project. Aliza confirmed she prepared application letters to the then-prime minister for five companies vying for this project, again on the instructions of Lian Tian Chuan. Nepturis was also the company that secured this project.
Underlying Shareholding and Control Dynamics

Aliza and Mohd Rizman Akum Khan became directors and held 50 per cent shares each of Nepturis in 2018. However, there was a verbal understanding that the shares were equally split among Aliza, Rizman, and Lian Tian Chuan, though this arrangement was not officially registered with the Companies Commission of Malaysia. Due to his significant stake and control, Lian Tian Chuan could instruct transactions in Nepturis' company account and played a role in finding projects, while Aliza and Rizman managed the company's operations. Lian's 30 per cent interest in Nepturis was also not disclosed to the Construction Industry Development Board (CIDB).
