Upholding Previous Convictions

The death sentences were initially handed down by the Shah Alam High Court on May 23, 2013. Pathmanabhan, Thilaiyalagan, R. Kathavarayan, and another individual, Matan, were all convicted of murdering Datuk Sosilawati Lawiya, bank officer Noorhisham Mohamad, lawyer Ahmad Kamil Abdul Karim, and Sosilawati’s assistant, Kamaruddin Shamsuddin. The crime took place at Lot 2001, Jalan Tanjong Layang, Tanjung Sepat, in Banting, between 8:30 pm and 9:45 pm on August 30, 2010.
Chain of Appeals and Acquittals

The path to this final decision involved several stages of appeal. In December 2015, the Court of Appeal dismissed the appeals of Pathmanabhan, Matan, Thilaiyalagan, and Kathavarayan. Subsequently, on March 16, 2017, the Federal Court upheld the convictions and death sentences for Pathmanabhan, Thilaiyalagan, and Kathavarayan. However, Matan was acquitted at that stage due to a lack of evidence to convict him. Notably, R. Kathavarayan withdrew his review application on the day of the hearing.
Evidence Supporting the Convictions

The motive for the murders was established as being related to a land transaction, with the victims tragically caught in the wrong place at the wrong time. Investigations at the plantation uncovered significant evidence, including burn marks and human remains. Experts confirmed these remains had been cremated at extremely high temperatures. Witness testimonies, such as that of a former maid who heard a woman screaming and saw flames on the night of the murder, corroborated the events. Further forensic findings included an area with bloodstains and a cricket bat bearing bloodstains. Chemical analysis confirmed that some of the blood matched Sosilawati and her associates, with DNA evidence of Noorhisham Mohamad found on the walls and cricket bat, and DNA of Kamaruddin Ahmad Kamil discovered on pieces of zinc.
