As of December 3, the Department of Manpower Peninsular Malaysia (JTKSM) has conducted 1,850 inspections to enforce the Workers’ Minimum Standards of Housing and Amenities Act 1990, also known as Act 446. These inspections have covered a significant portion of employers and accommodation providers across the peninsula and the Federal Territory of Labuan. The JTKSM has set an ambitious target of 25,000 inspections by the year 2021.
Inspections Cover Employers and Accommodation Providers

The 1,850 inspections carried out by JTKSM involved 1,813 employers and 37 centralised accommodation providers. This broad scope indicates a comprehensive effort to assess compliance with Act 446 across various entities responsible for housing workers. The inspections are part of a continuous enforcement drive to ensure adherence to minimum standards for worker housing.
Significant Non-Compliance Identified

These enforcement activities come in the context of a worrying statistic where 91.1 per cent, or approximately 1.4 million foreign workers, are housed in accommodations that do not comply with Act 446 provisions. As of October 31, only 143,587 foreign workers, representing 8.89 per cent of the total foreign workforce, were provided with accommodation that had received a Certificate of Accommodation.
Future Enforcement Measures Announced

Looking ahead, the government plans to make the Certificate of Accommodation a mandatory prerequisite for employers seeking to hire new foreign workers, effective July 1 next year. This means employers will need to secure this certificate from the Ministry of Human Resources before the Malaysian Immigration Department can issue a visa, ensuring that compliant accommodation is in place before foreign workers arrive in the country.
