Najib Razak Seeks to Reinstate RM1.9 Million Lawsuit Against Tommy Thomas

Datuk Seri Najib Razak is pursuing an appeal to revive a RM1.9 million lawsuit against former attorney general Tan Sri Tommy Thomas. The former prime minister alleges that Thomas committed misfeasance in public office during his prosecution in the 1Malaysia Development Berhad (1MDB) and International Petroleum Investment Company cases. The Court of Appeal has scheduled January 13 of next year to deliver its decision on this matter.
Allegations of Misfeasance in Public Office

In his statement of claim, Najib contends that Thomas acted with malice when initiating charges against him. These charges were related to abuse of power under Section 23 of the Malaysian Anti-Corruption Commission Act 2009, as well as several counts of money laundering under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001. Najib is seeking a declaratory judgment from the court confirming that Thomas's actions constituted the tort of misfeasance in public office.
Claim for Special Damages

Beyond the declaratory judgment, Najib is also claiming RM1.9 million in special damages. This sum is intended to cover the costs incurred by Najib in engaging an audit team. The purpose of this team was to meticulously review documentation and prepare Najib's defence for the criminal proceedings that were initiated during Thomas's tenure as attorney general, which lasted from June 4, 2018, to February 28, 2020.
Appeal Against High Court Decision

The current appeal stems from a decision made by the High Court on November 25, 2022. On that date, the High Court chose to strike out Najib's lawsuit against Thomas. Najib is now appealing this decision, aiming to have his case heard and reinstated at the appellate level.
Court of Appeal Sets Ruling Date

Following submissions from both parties, a three-member bench of the Court of Appeal, comprising Justices Datuk Ravinthran N Paramaguru, Datuk Wong Kian Kheong, and Datuk Nadzarin Wok Nordin, reserved its judgment on October 7. The court has since set January 13 next year as the date for the delivery of its decision regarding Najib's appeal.
