The Malaysian Anti-Corruption Commission (MACC) has identified Dubai (UAE), Singapore and Indonesia as the three key jurisdictions for documents to be obtained through the Mutual Legal Assistance (MLA) process. MACC chief commissioner Datuk Seri Abd Halim Aman said the MLA process will be initiated with the Attorney General’s Chambers (AGC) after it was determined that key documents related to the KWAP investments are believed to be located overseas.
MLA process will start after AGC involvement
MACC stated that it is working with the AGC to initiate the MLA process. This comes after the commission determined that key documents connected to the KWAP investments are held abroad, requiring formal cooperation to secure them.
The three targeted jurisdictions are Dubai, Singapore and Indonesia
MACC named Dubai (UAE), Singapore and Indonesia as the countries it is focusing on for the MLA requests. These jurisdictions were cited directly in connection with efforts to obtain documents relevant to the KWAP investment activities.
Investigation began on July 17 and is ongoing
The investigation into KWAP investment activities officially commenced on July 17 and is described as progressing smoothly. Since then, MACC has recorded statements from 20 witnesses, including KWAP and Ministry of Finance (MOF) officials, as well as members of KWAP’s Investment Committee and investment panel members.
MACC is also seeking financial intelligence and transaction reports
MACC said it wrote to Bank Negara Malaysia (BNM) seeking assistance in two areas. First, it requested financial intelligence through the Egmont Group of Financial Intelligence Units to trace the financial positions of two companies in Indonesia and one in Singapore; second, it asked BNM to review Cash Transaction Reports (CTR) and Suspicious Transaction Reports (STR) to establish the financial standing of individuals and entities linked to the investigation.
