The court therefore focused on whether Haritharan proved the constitutional conditions for citizenship, rather than whether he held documents.
Passports and IDs explain treatment, not citizenship status
The court accepted that Haritharan’s past documents and administrative records, including a Malaysian passport issued in 2002 when he was just over one year old, along with his MyKid number and school and immunisation records, could explain why he and his family believed he was Malaysian. However, it emphasised that these documents are not the legal source of citizenship. The key question remained whether he established, on the evidence before the court, that he was a Malaysian citizen by operation of law under the Federal Constitution.
Citizenship depends on constitutional requirements at birth
In Haritharan’s case, the court said having a Malaysian father did not automatically make him Malaysian because his Malaysian father and Thai mother were not married when he was born, which made his birth illegitimate in law. Applying Section 17 of the Federal Constitution’s Second Schedule, Part III, the court held that an illegitimate child can refer only to the mother for citizenship purposes. Because there was no evidence that his Thai mother was a Malaysian or a permanent resident at his birth, Haritharan failed to meet the constitutional condition.
“Not born” matters more than “currently recognised”
Haritharan also argued that he should be Malaysian because he was not born a citizen of any country, claiming statelessness. The court rejected an approach based on present recognition by another state, stating that the issue is whether he was “not born” a citizen of any country, not whether he is currently recognised as such. It found that he had not proven he was not born a citizen of any country, even though he said he had no citizenship.
Even embassy certificates about passports do not prove citizenship at birth
In a similar appeal involving two sisters born in Kuala Lumpur to a Malaysian father and a non-Malaysian mother, the Court of Appeal applied the same Section 17 reasoning tied to the parents’ unmarried status at birth. The court held the sisters were not entitled to Malaysian citizenship because they had to take on their mother’s non-Malaysian citizenship. Even certificates from the Philippines’ embassy stating the sisters had never applied for or been issued a passport did not establish they were not Filipino citizens at birth or that they did not acquire Filipino citizenship within one year after birth, so their lack of a passport was not treated as proof of constitutional citizenship status.
