IRB’s claim centred on late payment and added penalties
IRB alleged that Tengku Adnan failed to pay the income tax within 30 days from the date the Assessment Notice was delivered, as provided under Section 103 of the Income Tax Act 1967. IRB also said a 10 per cent increase was imposed, and after a further 60 days without full settlement, an additional five per cent interest was applied.
The court scheduled the suspension application hearing for Jan 7
Tengku Adnan’s application to suspend the proceedings was fixed to be heard on Jan 7 next year by High Court Judge Datuk Azimah Omar. The hearing date was set after case management in her chambers, which included senior revenue counsels Al-Hummidallah Idrus and Norhisham Ahmad representing IRB.
