Two Members of Parliament from the Malaysian Islamist party PAS have proposed that individuals identifying with the lesbian, gay, bisexual, and transgender (LGBT) community should be considered as having mental health illnesses. This suggestion was made during a parliamentary debate concerning amendments to the Mental Health Act 2001. Pasir Salak MP Jamaluddin Yahya posed the question to Kapar MP Dr Halimah Ali, who indicated her agreement to include this viewpoint in her speech.
Historical Context of Mental Health Classifications

Historically, diagnostic manuals have evolved in their classification of sexual orientation. The initial edition of the Diagnostic and Statistical Manual of Mental Disorders (DSM), published in 1952, did classify homosexuality as a mental disorder. However, this classification was revised and removed in a subsequent edition in 1973. The most recent iteration of the DSM, updated in 2013, no longer lists sexual orientation as a mental disorder.
Recognition of Gender Dysphoria

While the DSM no longer categorises sexual orientation as a mental disorder, its 2013 edition does include "gender dysphoria." This condition is described as experiencing significant distress or impairment when a person's gender identity does not align with their sex characteristics. This distinction highlights a difference between sexual orientation, which refers to an individual's pattern of emotional, romantic, and/or sexual attractions, and gender dysphoria, which relates to distress arising from incongruence between one's gender identity and assigned sex at birth.
Amendments to the Mental Health Act 2001

The suggestion by the PAS MPs was made during the parliamentary debate on a Bill to amend the Mental Health Act 2001. This proposed amendment, tabled by the Deputy Minister in the Prime Minister’s Department (Law and Institutional Reform), aims to revise specific sections of the Act. Notably, the amendments are consequential to the deletion of Section 309 of the Penal Code, which previously dealt with attempted suicide. The proposed changes seek to further define and empower crisis intervention officers in apprehending individuals believed to be mentally disordered and posing a danger to themselves or others, or those who attempt suicide, requiring them to be brought to a psychiatric facility within 24 hours.
