Over 100 foreign and local investors have not received approximately RM32 million in rental income from Karambunai Corporation Berhad (KCB) due to the company's alleged failure to uphold its leaseback agreements. These agreements, entered into when investors purchased luxury seaside villas at Nexus Resort Karambunai, promised a guaranteed rental income of around 7%. Payments reportedly ceased in early 2011, leading to a prolonged legal dispute and concerns over the deteriorating condition of the properties.
Non-Payment of Rental Income Since Early 2011

Investors who purchased villas, costing between US$300,000 and US$400,000, as part of the "Malaysia My Second Home" programme, have not received rental payments since early 2011. Despite KCB's previous commitment in a letter to the Nexus Property Owners' Association (NPOA) to pay all outstanding rent by December 2011, investors only received an initial sum in March 2011. A recent settlement offer from KCB was also rejected by the affected investors.
Allegations of Property Neglect and Deterioration

The NPOA has raised serious concerns that KCB's alleged neglect of the properties has caused their value to plummet. Investors have presented evidence, including photographs, showing villas in a state of disrepair, with issues such as water damage, mold on furniture and walls, rotting wood, and rusty balcony balustrades. Some villas are reported to have leaked roofs, and there are allegations of break-ins and theft due to lax security, as well as erosion in front of the villas despite seawalls.
Ongoing Arbitration and Legal Delays

A group of 108 affected investors is currently engaged in an arbitration process with KCB, which commenced in 2011. However, the process has reportedly been subject to delays, with KCB's lawyers allegedly using technical grounds in an attempt to impede the arbitration. The arbitrator's decision on whether the villa owners could proceed with the arbitration was postponed. In addition to non-payment, investors also face the challenge that land titles to their villas have not been transferred, preventing them from managing the properties themselves, which the NPOA suspects is due to a dispute over land ownership.
Financial Burden on Investors

Many of these investors are servicing bank loans for their villas, incurring average monthly payments of RM5,000 to RM6,000. The lack of rental income, coupled with ongoing loan repayments and concerns about property depreciation, has placed a significant financial strain on the investors. The NPOA is considering engaging a property consultant for inspections and exploring the establishment of a Malaysian firm to manage the villas.
