Fake News Dissemination Will Remain Controlled Post-Emergency Ordinances Revocation

The spread of fake news will continue to be curbed following the revocation of the Emergency Ordinances, with authorities utilising existing legal frameworks. Communications and Multimedia Minister Tan Sri Annuar Musa affirmed that the termination of these ordinances will not impede ongoing investigations or court proceedings related to such content. Cases that occurred during the period the ordinances were in effect can proceed under the law, with decisions on whether to pursue them resting with the Attorney General's Chambers.
Continued Enforcement Through Existing Laws

Even without the Emergency Ordinances, the government will continue to address the dissemination of fake news by employing established legislation. These include the Penal Code, the Printing Presses and Publications Act 1984, and the Communications and Multimedia Act 1998. These statutes provide the legal basis for investigating and prosecuting individuals found to be spreading false information.
No Compounds Issued Under Ordinances

During the enforcement of the Emergency Ordinances, no compounds, or out-of-court settlements for fines, were issued for fake news offences. This was due to the absence of specific provisions within the ordinances that allowed for such compounding. Despite this, cases were still brought before the courts, resulting in some individuals being fined.
Investigation and Prosecution Statistics

Between March 12 and October 21 this year, a total of 30 investigation papers were opened concerning fake news under the Emergency Ordinances. Of these, 26 have been settled, with 12 cases leading to charges being filed and 14 classified as no further action (NFA). Four cases remain under active investigation, with one being handled by the Royal Malaysia Police and three by the Attorney General’s Chambers and state prosecution directors.
