Lynas Waste May Be Allowed to Remain in Malaysia Pending Facility Approval

The Malaysian federal government is likely to abandon the requirement for Lynas Corp to export its rare earth processing waste to Australia as a condition for its licence renewal. Discussions within the Cabinet have centred on the feasibility of Lynas establishing a permanent disposal facility (PDF) within Malaysia. A definitive decision regarding the PDF, which would necessitate a US$50 million (RM206 million) security deposit from Lynas to fund the project, is expected to be announced next month.
Proposal for a Permanent Disposal Facility

Lynas has previously indicated that exporting 450,000 tonnes of water leach purification (WLP) residue by September is unmanageable. As a compromise, the company proposed the construction of a PDF in Malaysia. This proposal was accepted last year following a recommendation from an executive review committee appointed by the Ministry of Energy, Science, Technology, Environment and Climate Change.
Shift from Previous Stance

Previously, Minister Yeo Bee Yin had maintained that Lynas's licence renewal was contingent upon the repatriation of its waste to Australia. While Prime Minister Tun Dr Mahathir Mohamad initially indicated that Lynas could continue operations, this was later clarified by Minister Yeo to mean that the waste disposal requirement remained. Efforts by the ministry to have Australian authorities accept the waste were unsuccessful, with Australian officials rejecting the possibility.
Environmental Concerns and Public Opposition

The potential for Lynas's waste to remain in Malaysia has drawn significant attention. Approximately 88 non-governmental organisations (NGOs) have petitioned the government to revoke Lynas's licence, criticising the administration for what they perceive as favouritism towards the Australian firm. The issue of the Lynas rare earth refinery in Kuantan was also a significant talking point for Pakatan Harapan during their campaign prior to the 14th general election, contributing to the electoral success of prominent Lynas opponent Wong Tack.
Economic Potential of Rare Earth Industry

Despite environmental concerns, there is also recognition of the economic benefits associated with the rare earth sector. The Ministry of Entrepreneur Development has highlighted the industry's potential value at RM100 billion. Concurrently, the Ministry of Water, Land and Natural Resources has been exploring other potential sites for rare earth mining and development within the country.
